Terms of Service

1. Agreement
These Terms of Service (“Terms”) govern your access to and use of SpendWhat (including the product marketed as “Tiêu Gì” in some regions), our websites, and related services (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be able to form a binding contract in your jurisdiction and meet any minimum age requirements (e.g., 13+ or higher where applicable). If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
3. Accounts
You may need an account to use certain features. You are responsible for safeguarding your credentials and for activity under your account. Notify us promptly of unauthorized use. We may suspend or terminate accounts that violate these Terms or pose risk to the Service.
4. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms and applicable app store rules.
5. SpendWhat Pro and subscriptions
Optional paid features (“SpendWhat Pro”) may be offered via in-app purchase through Apple App Store or Google Play. Payment, renewal, cancellation, and refunds are handled by the applicable store under its terms. Subscription fees and taxes are as displayed at purchase. Features included in Pro are described in the app and may change with reasonable notice where required.
6. AI features
AI-generated outputs are for informational purposes only and may be inaccurate. You remain responsible for reviewing and confirming financial entries, tax treatment, and decisions. Do not rely on AI output as professional financial, legal, or tax advice.
7. Acceptable use
You agree not to:
- Violate laws or third-party rights;
- Attempt to gain unauthorized access to the Service or others’ data;
- Interfere with or disrupt the Service or infrastructure;
- Reverse engineer, scrape, or misuse the Service except as permitted by law;
- Use the Service to transmit malware or harmful content.
8. Intellectual property
The Service, including software, branding, and content we provide, is owned by SpendWhat or its licensors. You retain ownership of data you submit; you grant us a license to use that data to operate and improve the Service as described in our Privacy Policy.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPENDWHAT AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (IF YOU HAVE NOT PAID). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.
11. Indemnity
You will defend and indemnify SpendWhat and its affiliates against claims arising from your misuse of the Service or violation of these Terms, to the extent permitted by law.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access for violations, legal requirements, or discontinuation of the Service. Provisions that by nature should survive will survive termination.
13. Governing law
These Terms are governed by the laws of [Your jurisdiction], excluding conflict-of-law rules. Courts in [Your venue] have exclusive jurisdiction unless applicable law requires otherwise. Replace with your chosen governing law and venue.
